Understanding Section 97 of the Building Act 1993
Under Section 97, the owner undertaking the building work is responsible for paying the reasonable costs of the adjoining owner for:

Assessing the proposed protection works; and
-
Guiding the carrying out of those works.
When Annex is engaged to assist an adjoining owner, the invoice is sent directly to the owner who served the Protection Works Notice, not to the adjoining owner.
This ensures transparency, fairness, and compliance with the law.

Will I Have to Pay Anything? NO
Your costs for the assessment and process guidance are covered under Section 97 of the Building Act 1993.
Annex manages the invoicing directly with the building owner keeping the process simple and stress-free.
