What Is Protection Work?
Understanding Protection Works
When building or renovation work happens close to a boundary, it can affect nearby properties.
The Protection Works process, set out in the Building Act 1993, is designed to make sure adjoining properties are protected from damage during construction.
It’s a legal safeguard that requires the owner doing the building work to take all reasonable steps to protect neighbouring land and buildings from potential impact — such as movement, cracking, or water damage.

Read the Notice Carefully
Review all details of the proposed building works and the methods suggested to protect your property. Make note of any concerns or unclear items. -
Respond Within 14 Days
You must reply to the notice within 14 days — either agreeing, disagreeing, or requesting additional information from the building owner or their surveyor. -
Seek Professional Advice

The Protection Works Process
Notice → Response → Assessment → Compliance→ Completion
Notice: The owner undertaking the works serves a Protection Works Notice.
Response: The adjoining owner replies within 14 days.
Assessment: Annex reviews and assesses the proposed protection measures.
Completion: Works are completed and the adjoining property remains protected.

WHY NOTICES ARE ISSUED
You received a Protection Works Notice because your adjoining neighbour is planning to carry out building works that could affect your property. Under the Building Act 1993 and the Building Regulations 2018 (Victoria), they are legally required to notify and consult you before starting any works that may pose a risk to the safety, stability, or condition of your property.
This can include:

Excavation near your boundary

Foundation work

Building walls or structures close to your property

Major renovations or demolition; and

much more or like.
The Protection Works Notice outlines what steps your neighbour plans to take to protect your property during their construction. You’ll have the chance to review the proposal, ask for more information, and either consent or raise concerns.
